BlueEyes Kitchen – Terms & Service Policies

Effective Date: March 9, 2026 Updated

 

BlueEyes Kitchen (“we”, “us”, “our”) operates a home-based bakery and food service business from Devon, Alberta, and offers food items, custom cakes, and corporate catering services via blueeyeskitchen.com (the “Site”). We are fully insured with $2,000,000 in commercial liability coverage and certified by Alberta Health Services.

 

By accessing the Site and/or placing an order, you agree to be bound by these Terms & Conditions (“Terms”). Please read them carefully. We’ve tried to keep them straightforward because we believe in clear communication.

Part A: General Customer Policies 

**This section applies to all standard orders placed through our main menu.

1. General Ordering Policy

  • Freshly Made to Order:  Items at BlueEyes Kitchen are prepared fresh to order to ensure the highest quality and presentation. As an Artisan kitchen, advance notice is required and all orders are subject to availability.

  • Order Notice: A minimum of 24 hours’ notice is required for standard menu items. Availability is confirmed at the time of inquiry. Early booking is strongly encouraged, particularly for weekends and holidays, as space fills quickly.

  • Custom Orders: Custom cakes, themed cookies, and specialty designs require additional planning and preparation time. We recommend 7–14 days’ notice for custom work. All custom orders are accepted on a case-by-case basis, depending on design complexity, scheduling, and ingredient availability. Custom pricing and/or additional fees may apply.

  • Order Confirmation: Orders are considered confirmed once full payment or the required deposit has been received.

2. Payment, Cancellations & Modifications

We get it, life happens. Here’s how we handle changes.

 

  • Payment: Orders under $50: Full payment is required to confirm your order.
     Orders $50 or more: A 50% non-refundable deposit is due at booking. The remaining balance is due 48 hours before pickup/delivery.

 

  • Cancellation by You: 7+ days notice: Full refund, less the 50% non-refundable deposit for orders over $50.
    Less than 7 days notice: No refunds will be issued. We’ve already purchased ingredients and scheduled our kitchen time. We appreciate your understanding.

 

  • Modifications: Need to change your order? Let us know at least 72 hours in advance. We’ll do our best to accommodate, but changes may be subject to availability and price adjustments.

3. Pickup & Delivery

  • Pickup: Please be on time for your scheduled pickup. If you’re running late, give us a call. Orders not picked up within 24 hours of the scheduled time without communication will be considered forfeited without a refund.

  • Delivery: Delivery is available for a fee based on location. You are responsible for ensuring someone is available to receive the order at the agreed-upon time. We are not responsible for items left unattended.

4. Food Safety & Your Responsibility

This part is important. Once you’ve picked up your order or we’ve delivered it, you’re in charge of keeping it safe.

  • Handling: Follow any storage and handling instructions provided. Items requiring refrigeration must be refrigerated immediately.

  • Liability: Our legal responsibility for the food ends once it is successfully delivered or picked up. We are not liable for any food-related issues that arise from improper storage, handling, or consumption after this point.

5. Our Allergen & Gluten-Aware Kitchen Policy

​​BlueEyes Kitchen is not a certified allergen-free facility, however gluten-aware practices are followed to reduce cross-contact risk.

 

Our gluten-aware procedures include:

  • A dedicated gluten-aware work table located away from other stations

  • Ingredients stored in sealed tubs to reduce airborne gluten exposure

  • Covered workstation when not in use

  • Dedicated utensils (including stand mixer) and bakeware reserved only for gluten-free items (some shared items may still be used—gluten aware, not gluten free)

  • When mixing gluten items, the mixer is covered to help prevent airborne contaminates (when practical)

  • A HEPA filter running beside work stations

  • Full wipe-down of surfaces prior to baking gluten aware items

  • Gluten-aware baking scheduled first in the day to minimize airborne particles

Despite these precautions:

   ***Products may still contain trace gluten

   ***Not suitable for those with celiac disease or severe allergies

 

**Customers with allergies or sensitivities should notify when ordering so guidance can be offered.

Part B: Corporate Catering Policies

**This section applies specifically to orders placed through our Corporate Catering program.

1. Corporate Ordering Policy

  • Minimum Order & Pricing: Corporate menu pricing reflects a 10-guest minimum. If you're hosting a smaller group, we’re happy to work with you — custom pricing may apply to ensure the same quality and service standards.

  • Booking & Lead Time: To ensure the highest quality and service, we recommend placing your order at least 72 hours in advance. All orders are subject to kitchen availability.
    We understand that last-minute needs arise. When possible, we are happy to accommodate orders placed within 48 hours; however, these are subject to availability and a 15% rush fee will apply.

    As an Artisan, chef-prepared kitchen, each order is thoughtfully crafted and scheduled to maintain our quality standards. While we make every effort to accommodate requested delivery times, all bookings are confirmed based on availability.

  • Securing Your Date: Your event is officially confirmed once we receive a signed quote along with the required deposit or full payment.

**BlueEyes Kitchen is licensed as a production-only facility. All food is prepared for off-site consumption; we do not host on-site dining, and all serviceware is disposable or retrieved off-site.**

2. Payment, Cancellation & Modifications

To ensure we can source the freshest ingredients for your event, we require the following payment structure, which is standard for custom caterers in Alberta:

  • Deposit: A 50% deposit is required at the time of booking.

  • Final Payment: The remaining balance is due 48 hours prior to your event.

  • Accepted Payments: We accept cash, e-transfer, certified cheque and company cheques.

  • Flexibility for Corporate Accounts: We understand that some larger organizations have specific procurement processes. While our standard terms require payment before the event, we are happy to discuss alternative payment arrangements on a case-by-case basis for established corporate clients. Please contact us to discuss your company’s needs.

  • Cancellation:

         * 14+ days notice: Full refund of your deposit.

          *7-13 days notice: Your 50% deposit will be forfeited.

          *Less than 72 hours notice: The full invoice amount is due.

  • Modifications: Menu or guest count changes must be made at least 7 days prior to the event. Increases are subject to availability.

2. Delivery & Venue & Equipment

  • Delivery Area: Our standard delivery area includes Devon, Leduc, Nisku, and South Edmonton. Fees may apply. Orders outside of this area will be approved on a case-by-case basis.

  • Venue Access: Please ensure we have access to the event space at the agreed-upon time. Delays may incur additional fees.

  • Insurance: We carry $2 million in commercial liability insurance. A Certificate of Insurance (COI) is available upon request for your procurement department.

  • Equipment Serviceware & Rentals: Unless otherwise specified, all catering orders are delivered on standard high quality disposable serviceware, including plates, bowls, cutlery, serving platters and serving utensils, which the Client may keep or discard. At the Client’s request, BlueEyes Kitchen can provide a Premium Presentation Upgrade, which includes palm leaf style (or similar quality) disposable plates, sturdier cutlery, and upgraded serving utensils. All items provided remain single use and are not collected or washed on site. If any non disposable rental items are supplied by BlueEyes Kitchen on a case by case basis, those items remain the property of BlueEyes Kitchen and must be made available for pickup in their original condition. The Client is responsible for the full replacement cost of any lost, damaged, or unreturned rental equipment.

Part C: Privacy Policy

We are committed to protecting your privacy.

  • What We Collect: We collect only the necessary information required to process your order, which includes your name, email, phone number, and event details.

  • What We Do With It: The information we collect is utilized to communicate with you regarding your order and for internal records. If you have opted in to our newsletter or updates, your contact information will also be used for those purposes, and you may unsubscribe at any time. **Note: Unsubscribe link is located at the bottom of all emails received from BlueEyes Kitchen and/or CreationHub.**

  • What We Don’t Do: We will never sell, rent, or share your personal information with any third parties.

Part D: General Legal Protections

This section applies to all customers and clients.

  • Limitation of Liability: In no event shall BlueEyes Kitchen be liable for any indirect, incidental, or consequential damages. Our total liability to you for any and all claims arising from our services is limited to the total amount paid by you for the order in question.

  • Indemnification: You agree to indemnify, defend, and hold harmless BlueEyes Kitchen, its owners, and employees from any claims, damages, liabilities, or expenses (including legal fees) arising from your breach of these terms, your negligence, or any issues arising from the improper handling, storage, or serving of food by you or your guests after delivery/pickup.

  • Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, power failures, or government restrictions.

  • Marketing & Photography: BlueEyes Kitchen reserves the right to photograph our food and catering setups at your event for promotional use on our website and social media.  We will never photograph your guests or use your corporate logo without your prior consent

  • Governing Law: These terms shall be governed by the laws of the Province of Alberta, Canada.

Part E: Newsletter & Website Subscription Terms

By subscribing to the BlueEyes Kitchen website or newsletter, you agree to the following terms and conditions. These terms apply to all email communications, promotional messages, and updates sent by BlueEyes Kitchen.

1.Subscription Consent

By entering your email address and subscribing, you consent to receive email communications from BlueEyes Kitchen, including but not limited to:

  • menu updates

  • special offers or promotions

  • seasonal announcements

  • corporate catering updates

  • general business news

Subscription is completely voluntary, and you may unsubscribe at any time.

2.Frequency of Emails

BlueEyes Kitchen aims to keep communications relevant and reasonable. Email frequency may vary depending on seasonal offerings, promotions, or business updates. We do not send excessive or daily emails.

3.Unsubscribing

You may unsubscribe from our mailing list at any time by:

  • clicking the “unsubscribe” link included at the bottom of any email, or

  • contacting us directly at info@blueeyeskitchen.com

Once unsubscribed, you will no longer receive marketing or promotional emails from us.

4.Use of Personal Information
  • Your email address and any information you provide are used solely for communication purposes related to BlueEyes Kitchen.

  • We do not sell, rent, or share subscriber information with third parties.

  • Subscriber information is stored securely and used in accordance with applicable privacy laws.

5.Accuracy of Information

Subscribers are responsible for ensuring the email address provided is accurate and current. BlueEyes Kitchen is not responsible for missed communications due to incorrect or outdated contact information.

6. Modifications to Subscription Terms

BlueEyes Kitchen reserves the right to update or modify these subscription terms at any time. Changes will take effect immediately upon being posted on our website.

Part F: Official Contest Rules

BlueEyes Kitchen — Artisan Sampler Box Giveaway

NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING.

1.Sponsor

This Contest is sponsored by BlueEyes Kitchen (the "Sponsor"), a home-based artisan bakery located in South Ravines, Devon, Alberta, Canada. BlueEyes Kitchen operates in full compliance with Alberta Health Services (AHS) food safety regulations and holds a valid Food Handling Permit. The Sponsor's facility has been inspected and approved by Alberta Health Services. For contest inquiries, contact the Sponsor at: info@blueeyeskitchen.com.

2.Eligibility

This Contest is open to legal residents of Canada who, at the time of entry:

  • Are 18 years of age or older;

  • Reside, work, or operate a registered business within a 25-kilometre radius of Devon, Alberta; and

  • Hold a valid email address and have internet access.

The following persons are not eligible to enter:

  • Employees, contractors, agents, and representatives of the Sponsor;

  • Immediate family members (defined as spouse, common-law partner, parent, sibling, or child) and household members of any of the above.

The Sponsor reserves the right to verify eligibility at any time and to disqualify any entrant who cannot satisfy these requirements.

3. Contest Period

The Contest commences at 12:00 AM Mountain Standard Time (MST) on February 23, 2026 and at 12:00 AM the day after each draw until contest ending (“date to be determined”), with draws held twice monthly on the 1st and 15th of each calendar month (each, a "Draw Date"), with the exception of March, draws will be held on the 4thand 15th of the month, until the Sponsor formally announces the conclusion of the Contest "until further notice".

 

Each entry period closes at 5:30 PM MST on the applicable Draw Date (the "Closing Time"). Entries received after the Closing Time for a given draw will be considered void for that draw and will not carry forward to future draws unless the Sponsor expressly states otherwise.

4. How To Enter

To enter, visit www.blueeyeskitchen.com/give-away during the Contest Period and complete the online entry form as directed. Each entrant may submit one (1) entry per valid email address per draw period. Multiple entries from the same email address will result in the disqualification of all such entries from that draw. Automated, robotic, scripted, or otherwise mechanically generated entries are prohibited and will be void.

 

There is no entry fee and no purchase of any kind is required to enter or win.

5. Marketing Communications & CASL Compliance

Entering this Contest does not constitute consent to receive commercial electronic messages (CEMs) from the Sponsor, including newsletters or promotional emails.

If you wish to receive the BlueEyes Kitchen newsletter and/or promotional communications, you must separately and voluntarily check the following opt-in box on the entry form — which will appear unchecked by default:

By subscribing, I consent to receive email communications from BlueEyes Kitchen.  You may unsubscribe at any time.. By checking this box you acknowledge you have read and agree our Terms & Conditions"

Subscribing to the newsletter is not a condition of entry or of winning. The Sponsor will maintain records of all marketing consents in compliance with Canada's Anti-Spam Legislation, SC 2010, c 23 ("CASL").

6. Prizes

The following prizes are available for each draw (each, a "Prize"):

Prizes must be accepted as awarded and are non-transferable. No cash substitution or alternative prize is permitted. Prizes have no cash value. The Sponsor is not responsible for prizes that are damaged during delivery. Prize delivery will be made to a valid address within the 25-kilometre eligible geographic radius within 72 hours of the Draw Date, or such other mutually agreed time confirmed in writing between the winner and the Sponsor following the draw. All Prize items are freshly prepared in an AHS-inspected and certified facility

 

Competition Act Compliance Note: The number, approximate value, and regional scope of prizes are disclosed above as required under the Competition Act, RSC 1985, c C-34.

7. Winner Selection & Odds

Draw Process: On each Draw Date, at approximately 6:00 PM MST(or such other time as announced on the Sponsor's social media channels), the Sponsor will conduct a live draw via social media (Facebook and/or Instagram) using the BlueEyes Kitchen Contest App (a randomized digital wheel).

 

The Guest Spinner: For all draws after the first draw (March 4, 2026), the winner of the immediately preceding draw (the "Guest Spinner") will be invited to initiate the live digital draw on a voluntary basis. If the Guest Spinner is unavailable, declines to participate, or cannot be reached within 30 minutes of the scheduled draw time, the Sponsor will conduct the draw manually without delay.

 

Privacy During the Draw: To protect entrants' personal information in accordance with Alberta's Personal Information Protection Act, SA 2003, c P-6.5 ("PIPA"), only the business name (for business entrants) or the entrant's first name and last initial (for individual entrants) will be displayed on the digital wheel during the live draw regulations.

 

Odds: The odds of winning depend on the total number of eligible entries received for the applicable draw period. No regional allocation of prizes applies.

8. Winner Notification & Skill Testing Question

Potential winners will be contacted via the email address provided at entry within 24 hours of the applicable Draw Date.

As required by Canadian law, a random draw constitutes an illegal lottery under the Criminal Code of Canada unless a skill component is incorporated. Accordingly, to be officially declared a winner and claim their Prize, each selected entrant must:

  1. Correctly answer a Skill-Testing Question: The potential winner must, without assistance and without the use of any mechanical, electronic, or other computational aid, correctly answer a time-limited, multi-step mathematical skill-testing question chosen by the Sponsor and administered at the time of prize delivery or by telephone or video call at the Sponsor's discretion. The question will follow the format: (A×B)+C−D=? using two-to-three-digit numbers. The question will not be disclosed in advance.

  2. Execute a Declaration and Release Form (if requested by the Sponsor), confirming eligibility and compliance with these Official Rules.

A potential winner who fails to correctly answer the skill-testing question, fails to respond within 48 hours of the winner notification email, provides false eligibility information, or is otherwise found to be ineligible will be disqualified. An alternate winner will then be selected from remaining eligible entries for that draw period using the same process. If no eligible alternate winner can be identified, the Prize for that draw may go unawarded at the Sponsor's discretion.

9. Privacy & Personal Information (PIPA)

The Sponsor collects personal information (including name, email address, business name if applicable, and other information provided on the entry form) solely for the purpose of administering this Contest, in compliance with Alberta's Personal Information Protection Act, SA 2003, c P-6.5.

  • Personal information will not be used for any marketing or promotional purpose without your separate, express consent (see Section 5).

  • Personal information will be retained only for as long as necessary to administer the Contest and resolve any related disputes, after which it will be securely destroyed.

  • You may request access to, correction of, or deletion of your personal information by contacting the Sponsor at support@blueeyeskitchen.com.

 

Winner Consent to Promotional Use: By accepting a Prize, a winner consents to the Sponsor's use of their first name and last initial, photograph, and/or short video taken at the time of prize delivery, for promotional purposes on the Sponsor's website and social media channels, without further compensation. A winner may withdraw this consent at any time by contacting the Sponsor; however, such withdrawal will not affect the validity of the Prize already awarded.

10. Limitation of Liability

The Sponsor, its affiliates, directors, officers, employees, agents, and representatives are not responsible for:

  • Lost, late, misdirected, incomplete, illegible, or otherwise invalid entries,

  • Technical failures of any kind, including failures of the website, application, internet connection, or digital draw wheel,

  • Errors, omissions, interruptions, deletions, defects, or delays in Contest administration,

  • Any injury, loss, or damage of any kind — including property damage or personal injury — arising from participation in this Contest or the acceptance, delivery, or use of any Prize.

By entering this Contest, all participants release and hold harmless the Sponsor and the above-named parties from any and all claims, damages, actions, or liability arising from or in connection with participation in this Contest or the acceptance and use of any Prize.

11. General Conditions
  • This Contest is subject to all applicable federal, provincial, and municipal laws and regulations, including: the Criminal Code of Canada (RSC, 1985, c C-46); the Competition Act (RSC, 1985, c C-34); Canada's Anti-Spam Legislation (SC 2010, c 23); and Alberta's Personal Information Protection Act (SA 2003, c P-6.5).

  • The Sponsor reserves the right, in its sole discretion and without prior notice, to cancel, modify, or suspend the Contest if fraud, technical failures, tampering, or any other factor beyond the Sponsor's reasonable control impairs the integrity or proper functioning of the Contest.

  • Any attempt to deliberately undermine the operation or integrity of this Contest may constitute a violation of applicable criminal and civil laws, and the Sponsor reserves the right to fully seek damages permitted by law.

  • The Sponsor's decisions on all Contest matters are final and binding.

  • This Contest is in no way sponsored, endorsed, administered by, or associated with Meta Platforms, Inc. (Facebook or Instagram) or any other social media platform on which it may be promoted. By entering, participants fully and completely release Meta Platforms, Inc. from any and all Contest-related claims.

  • This Contest is void where prohibited by law.

12. Governing Law & Dispute Resolution

This Contest is governed by and construed in accordance with the laws of the Province of Alberta and the applicable federal laws of Canada. Any dispute arising from this Contest shall be submitted to the exclusive jurisdiction of the courts of Alberta.
